EVENT, RETREAT, WELLNESS ACTIVITY & PROPERTY LIABILITY WAIVER

ASSUMPTION OF RISK, RELEASE OF LIABILITY, MEDICAL CONSENT & AGREEMENT

PLEASE READ CAREFULLY — THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS

By signing this Agreement, you voluntarily waive certain legal rights, including the right to sue.

1. PARTIES

This Agreement is entered into between the undersigned participant (“Participant”) and:

Mystic Hearts Healing Collective, LLC

Temple Sacred Heart Church

Inner Goddess Retreats, Inc. non profit

3 Hands Healing

La Lighthouse Holistic Co-op

Yoga 4 Love

Maria Mossie 

Lisa Farrell-Ware (“Aiylah Valkyrie”)

Jamie Ray (“Takata RA”)

Collectively referred to herein as the “Released Parties” and/or “Land Caregivers.”

Activities may occur at:

5700 Blue Bluff Road, Austin, Texas 78724

5614 Blue Bluff Road, Austin, Texas 78724

or any affiliated event, retreat, gathering, ceremony, class, workshop, festival, outdoor activity, online experience, or related venue operated by the Released Parties.

2. PARTICIPANT INFORMATION

3. DESCRIPTION OF ACTIVITIES

Participant understands and agrees that activities may include, but are not limited to:

retreats

camping

hiking

swimming

hot tub use

yoga

ecstatic dance

movement practices

meditation

breathwork

ceremonies

drumming

chanting

sound healing

fire spinning demonstrations

fire ceremonies

sweat lodge participation

cooking

vending

volunteer work

setup/breakdown activities

community gatherings

outdoor recreation

water activities

wellness workshops

spiritual practices

physical activity

use of land, trails, pools, structures, equipment, and facilities

Participant voluntarily elects to participate in these activities.

4. ASSUMPTION OF RISK

Participant understands that participation in retreat, wellness, outdoor, and ceremonial activities involves inherent risks, including but not limited to:

slips, falls, and physical injury

drowning

dehydration

heat exhaustion

allergic reactions

smoke/fire exposure

insect or animal encounters

emotional or psychological distress

physical exertion

accidents involving equipment or facilities

injury caused by other participants

acts of nature

unknown or unforeseeable risks

Participant knowingly and voluntarily assumes all risks, whether known or unknown, associated with participation and presence on the property.

Participant acknowledges that no guarantees regarding safety have been made.

5. RELEASE OF LIABILITY (agree on form)

To the fullest extent permitted under Texas law, Participant hereby releases, waives, discharges, and covenants not to sue the Released Parties from any and all claims, liabilities, demands, damages, causes of action, costs, or expenses arising out of or related to:

participation in activities

use of facilities or property

presence on the land

negligence of Released Parties

acts of other participants

injury, illness, emotional distress, death, or property damage

This release applies whether arising from negligence or otherwise, except in cases of gross negligence or intentional misconduct as prohibited by Texas law.

6. MEDICAL RESPONSIBILITY (agree on form)

Participant affirms that they are physically, emotionally, and mentally capable of safely participating in retreat and wellness activities.

Participant agrees to:

disclose relevant medical conditions if necessary

take full responsibility for their own health and wellbeing

maintain personal hydration and self-care

seek medical care if needed

Participant understands that the Released Parties are not medical providers and do not provide medical or psychological treatment.

Participant voluntarily assumes all responsibility for any medical costs incurred.

7. EMERGENCY MEDICAL CONSENT (add to form)

In the event of an emergency, Participant authorizes the Released Parties to obtain emergency medical treatment deemed reasonably necessary.

Participant understands that:

emergency services may be delayed due to rural or outdoor conditions

Participant is solely financially responsible for any medical care provided

8. CODE OF CONDUCT (agree on form)

Participant agrees to:

follow all posted and verbal safety instructions

respect the land, facilities, and community

refrain from violent, abusive, threatening, or disruptive behavior

participate responsibly in all activities

Participant understands that the retreat environment is alcohol-free and psychedelic-free unless otherwise explicitly stated in writing.

The Released Parties reserve the right to remove any Participant from the property without refund for behavior deemed unsafe, disruptive, abusive, illegal, or harmful to the container.

9. PHOTOGRAPHY & MEDIA RELEASE (agree on form)

Participant grants permission for photographs, video recordings, and media captured during events to be used by the Released Parties for lawful promotional, educational, marketing, and social media purposes.

Participant may submit a written request prior to the event if they do not wish to appear in identifiable media.

10. PROPERTY DAMAGE (agree on form)

Participant agrees to be financially responsible for any damage caused by negligent, reckless, intentional, or unlawful conduct by Participant or Participant’s guests.

11. INDEMNIFICATION (agree on form)

Participant agrees to indemnify, defend, and hold harmless the Released Parties from any claims, damages, liabilities, losses, attorney’s fees, or expenses arising from Participant’s actions, participation, or breach of this Agreement.

12. GOVERNING LAW (agree on form)

This Agreement shall be governed by and interpreted under the laws of the State of Texas.

13. DISPUTE RESOLUTION (agree on form)

The parties agree to first attempt good-faith informal resolution of any dispute.

If unresolved, disputes shall proceed to mediation in Travis County, Texas.

If mediation is unsuccessful, disputes shall be resolved through binding arbitration pursuant to the rules of the American Arbitration Association.

Judgment on any arbitration award may be entered in any court of competent jurisdiction in Texas.

14. SEVERABILITY (agree on form)

If any provision of this Agreement is held invalid or unenforceable, all remaining provisions shall remain in full force and effect.

15. VOLUNTARY EXECUTION (agree on form)

Participant acknowledges that:

they have carefully read this Agreement

they understand its contents

they understand they are waiving certain legal rights

they sign voluntarily and without coercion

they have had the opportunity to seek independent legal counsel

IMPORTANT NOTICE

By signing this Agreement on the form, you acknowledge that participation in retreat, wellness, spiritual, movement, and outdoor activities involves inherent risk and that you voluntarily assume responsibility for those risks.
